Due to the very difficult housing rental market, the Richmond City Council asked that staff prepare a list of resources that are currently available to assist renters and landlords to advise them of their rights and responsibilities, and that might be of assistance in resolving conflicts over rent increases and other issues. Rent Control and Just Cause for Eviction

Ordinance Number 21-15 N.S. establishing a rent control board and just cause requirements for evictions
HAS BEEN REPEALED.

A referendum petition protesting the adoption of Ordinance Number 21-15 establishing a rent control board and just cause requirements for evictions was determined to have a sufficient number of valid signatures for the ordinance to be suspended.   On November 3, 2015, by a unanimous vote (7-0), the City Council repealed the rent control ordinance, in accordance with Elections Code Sections 9237 and 9241.  Consequently, the rent control and just cause for eviction ordinance has no force or effect and the City Council may not adopt the same ordinance for one year per Elections Code Section 9241.

On February 17, 2015, the Richmond City Council directed City staff to draft an ordinance establishing a Just Cause requirement for evictions specific to the City of Richmond and convene a working group of stakeholders to determine an amiable solution. A chronological list of meetings, City Council directives and associated documents are included below. Final Motion Item K-2: On motion of Councilmember McLaughlin to approve Option D (introduce an ordinance amending the Richmond Municipal Code to establish Rent Control plus Just Cause for Eviction)  with the following amendments:  include an allowable increase in rate up to 100% CPI (Consumer Price Index); the interim rent board be appointed rather than having the City Council serve as the interim rent board and the rent board be only five (5)  appointees without specification; the elected and appointed interim board be only five (5) members rather than seven (7) without specification; revise the Powers and Duties, Section 11.100.0309(f)(15) to state, “Determine allowable rent increase pass-through costs for sewer increases or other property related fee increases above CPI as necessary”; base rent start on July 21, 2015; policy program be up and running on November 1, 2015; and clarification in the ordinance that the inclusion of Section 8 units is for Just Cause for Eviction units only and not for rent control, seconded by Beckles, with a friendly amendment by Vice-Mayor Myrick to change the effective date of the policy program to December 1, 2015, the friendly amendment was accepted, and the motion passed by the following votes:  Ayes: Councilmembers Beckles, Martinez, McLaughlin and Vice Mayor Myrick.  Noes:  Councilmember Bates.  Abstentions: None.  Absent: Councilmembers Pimplé and Mayor Butt.
