Owner Move-In (OMI) Information
Section 11.100.050(a)(6) of the Fair Rent, Just Cause for Eviction, and Homeowner Protection Ordinance (Rent Ordinance) provides that a Landlord may seek to recover possession of a rental unit in good faith for the use and occupancy as a Primary Residence by the Landlord or the Landlord’s spouse, children, parents, or grandparents. Regulations clarifying the intent of this Section of the Rent Ordinance are contained in Chapter 10 of the Rent Board's adopted regulations, specifically in Regulations 1009 and 1010.
The table below contains forms and notices provided by the Rent Program for Tenant and Landlord use. Landlords and agents are encouraged to contact the Rent Program and/or seek legal advice prior to initiating the process to recover possession of a Rental Unit for owner or qualified relative occupancy to ensure all requirements are met, including, but not limited to, property enrollment, tenancy registration, and payment of the Rental Housing Fee. The Rent Program is unable to provide legal advice.
For your convenience, the Rent Program has provided sample forms where appropriate. Please note, the Rent Program does not guarantee the legal validity of "Sample" forms and notices, but rather provides these templates for informational purposes. Please consult with an attorney as to the legal sufficiency of any "Sample" forms and/or notices you choose to serve on a Tenant.

termination of tenancy to recover possession of a Rental Unit for the purposes of moving themselves or a qualifying
relative into the unit is required to complete this form and file with the Richmond Rent Board within 30 days of the Tenant
moving out of the Rental Unit. |

relative into the unit is required to complete this form and file with the Richmond Rent Program within thirty (30) days of
the Landlord or the Landlord’s qualifying relative moving into the property as their primary residence. |

Pursuant to City of Richmond Rent Board Regulation 1010(C), a Landlord who serves a Tenant with a notice of
termination of tenancy to recover possession of a Rental Unit for the purposes of moving themselves or a qualifying
relative into the unit is required to complete this form every twelve (12) months for thirty-six (36) consecutive months and
file with the Richmond Rent Program to certify that the Landlord or the Landlord’s qualifying relative continues to reside
(or not) in the unit as their Primary Residence. This form must be completed every twelve (12) months from the initial
move-in date for thirty-six (36) months following the move-in date.

Pursuant to City of Richmond Rent Board Regulation 1010(C)(2), a Tenant who vacates a Rental Unit due to a notice of
termination of tenancy for Owner Move-In shall inform the Landlord of their most current address or contact information so
as to permit the Landlord to reoffer the Tenant the Rental Unit if it ever should be reoffered for Rent. Tenants are strongly
encouraged, but not required, to update the Rent Program of any changes to their permanent contact information. |
